A UFO enthusiast who hacked into top-secret US military computers appealed to the Home Secretary yesterday to stop his extradition after losing a legal appeal

Gary McKinnon is due to be extradited to the United States within two weeks and could face a sentence of up to 80 years in a maximum-security prison if found guilty He admits to having accessed 97 US Navy, Army, Nasa and Pentagon computers in what has been described as “the biggest computer hack of all time”

Mr McKinnon, 42, an unemployed systems analyst, has said that he was looking for computer files containing details about UFOs and aliens The US Government says that he stole passwords, deleted files and left threatening messages

Mr McKinnon, of Palmers Green, North London, admitted carrying out the hacks using a computer in the bedroom of a house owned by his girlfriend’s aunt He says that he was motivated by curiosity and gained entry only because of lax security

He had asked the European Court of Human Rights to stay his extradition pending an appeal, but the application was refused yesterday He lost appeals to the High Court last year and to the House of Lords last month

US prosecutors allege that he caused nearly $1 million (£550,000) in damage The US military says that he rendered 300 computers at a US Navy weapons station unusable immediately after the September 11 attacks

Mr McKinnon had become obsessed with a theory that the US was using alien technologies to create weapons and “free energy” He gave up his job and spent hours every night hacking in search of evidence

He hacked into 53 US Army computers and 26 US Navy computers, including those at US Naval Weapons Station Earle in New Jersey, which is responsible for replenishing munitions and supplies for the Atlantic Fleet. Calling himself Solo, he left a threatening message: “US foreign policy is akin to government-sponsored terrorism these days? It was not a mistake that there was a huge security stand-down on September 11 last year . . .
I am SOLO I will continue to disrupt at the highest levels”

He was caught in November 2002 as he tried to download a grainy black-and-white photograph that he believed was of an alien craft held on a Nasa computer in the Johnson Space Centre in Houston, Texas He was easily traced by the authorities because he used his girlfriend’s e-mail account

Mark Summers, an official representing the US Government, said that Mr McKinnon’s hacking was “intentional and calculated to influence and affect the US Government by intimidation and coercion”

If extradited, Mr McKinnon faces trial on eight charges of computer fraud.
Each charge could carry a sentence of ten years in jail and a $250,000 fine It is likely that he would receive a much lighter sentence and that, under a plea bargain offer, he would spend six to 12 months in a US jail before being returned to Britain to serve the rest of his sentence

Mr McKinnon has previously said: “What I did was illegal and wrong, and I accept I should be punished. But I am not a member of al-Qaeda.
I believe my case is being treated so seriously because they’re scared of what I’ve seen I’m living in a surreal, nutter’s film”

He has suggested that the US authorities should take advantage of his expertise rather than prosecute him “The reason I left not just one note, but multiple notes on multiple desk-tops, was to say ‘Look, this is ridiculous’”

Karen Todner, from Kaim Todner solicitors, said that Mr McKinnon was “distraught” about the decision by the European Court of Human Rights and appealed to Jacqui Smith, the Home Secretary, to intervene “He is terrified by the prospect of going to America,” she said

Ms Todner added that the alleged offences had been committed on British soil and so he should be tried here She also said that Mr McKinnon had recently been found to have Asperger’s syndrome

I caught up with Gary McKinnon in North London on my way back from safari in Kenya. The interview was shot using a hand-held camcorder and uploaded at 4 am UK time, making use of a wireless connection outside of an office building in downtown Birmingham. This is what is known as guerilla filmmaking...

We sat in the back of his local pub, in a garden in the late afternoon. Gary is lucid, eloquent and extremely intelligent. He made it clear that the real reason the Americans want to extradite him is not for any damage he has done, for in fact there wasn't any.
They are pursuing him is because of what he might have seen Specifically, documents revealing a list of "Non-terrestrial officers" and off-world cargo operations somewhere out in space, hinting at the real possibility of military activities taking place in relation to other planets

Such a possibility has got to be mind-blowing to the average person who barely grasps that there might actually be aliens from other worlds interacting with earth and governments in the vicinity of our solar system. Key to the whole extradition matter is the issue that there were NO passwords required in order to access this material... and that a relatively unprofessional hacker, self-taught albeit brilliant, would be able, using a dial-up modem, to gain top secret access to NASA files and places as sacrosanct as the Pentagon

A British man who hacked into computers at the Pentagon will face trial in the US after the law lords ruled that he should be extradited

At the House of Lords this morning, Gary McKinnon, 42, was told that his appeal against extradition would not be granted

McKinnon, an unemployed computer systems administrator from north London, invaded computer systems belonging to the US military in 2001 – shortly after the attacks on the World Trade Center and the Pentagon

He said he was merely searching for evidence of extraterrestrial life, but American officials labelled him the world's most dangerous hacker and accused him of deleting important files and causing hundreds of thousands of dollars' worth of damage

According to prosecutors, McKinnon scanned more than 73,000 US government computers and hacked into 97 machines belonging to the US army, navy, air force and Nasa

His lawyers have fought vigorously against the extradition, arguing that McKinnon could face up to 60 years in prison as a result of his actions, and could even be classed as an "enemy combatant" and interned at Guantánamo Bay Instead they argued that he should face prosecution under Britain's more lenient computer crime laws because he carried out the hacking from his bedroom in London

But the law lords today rejected that argument "The difference between the American system and our own is not perhaps so stark as the appellant's argument suggests," said Lord Brown of Eaton-under-Heywood in his ruling

"It is difficult to think of anything other than the threat of unlawful action which could fairly be said so to imperil the integrity of the extradition process as to require the accused to be discharged irrespective of the strength of the case against him"

In a statement, McKinnon's legal team said it would be taking the appeal to the European Court of Human Rights

"Gary McKinnon is neither a terrorist nor a terrorist sympathiser," the statement said.
"His case could have been properly dealt with by our own prosecuting authorities Instead, we believe that the British government declined to prosecute him to enable the US government to make an example of him

"American officials involved in this case have stated that they want to see him 'fry' The consequences he faces if extradited are both disproportionate and intolerable and we will be making an immediate application to the European Court to prevent his removal"

Threat Level extends its warmest welcome to hacker Gary McKinnon, who just lost his extradition appeal to the U.K.'s highest court and will soon be pressing his search for extraterrestrial life from the confines of a U.
S detention facility

Federal prosecutors in New Jersey and Virginia have been trying to extradite the 42-year-old Londoner for six years to put him on trial for penetrating over 90 unclassified Pentagon systems in 2001 and 2002 -- and allegedly crashing some of them In interviews, McKinnon has admitted the hacking spree (though not the damage), which he says was a search for evidence of a military UFO coverup

Apparently he was stoned through a lot of it, which explains why most of the intrusions were into Army computers, when everyone knows the Air Force is hiding the UFOs. McKinnon's noble quest for the truth about extraterrestrial life also obliged him to leave this message on an Army computer in 2002: "U.S. foreign policy is akin to government-sponsored terrorism these days ... It was not a mistake that there was a huge security stand down on September 11 last year ... I am SOLO I will continue to disrupt at the highest levels"

McKinnon is a cause célèbre in Britain.
Playing on stereotypes, he's persuaded the more gullible sectors of the British press that American spooks want to ship him to Guantanamo, or put him in prison for 60 years But McKinnon is a petulant child who refused even the mildest sanctions for crimes that he's largely admitted conducting

According to his lawyers, the United States offered McKinnon a deal of six months to a year in U.S. federal custody, followed by repatriation by the U.K., where he'd be eligible for parole after six months. McKinnon turned it down, then went running to the U.K.
courts whining that the big bad Americans were trying to extort him into pleading guilty You think? That's what a plea bargain is, slick

And six to 12 months is quite a bargain indeed. It's minimum security camp time: We're talking ping-pong tables and a sunny running track. Now he's looking at the same kind of sentence U.
S hackers get -- measured in years, not months, and based on the financial losses a jury finds him responsible for

The House of Lords on Wednesday said it was troubled by some aspects of the plea negotiations -- such wheeling and dealing over a defendant's fate is alien to the United Kingdom -- but it upheld McKinnon's extradition order The hacker now vows to take his case to the European Court of Human Rights, which surely has nothing better to do
