The University of Minnesota's Boynton Health Service is reporting that they broke the Guinness World Record for flu shots given in one day They have more than doubled the record and still have more than two hours to go-
They can't say they are a top three research university, but at least they can brag about a world record How does the campus celebrate? Students sulked home with minor flu-like symptoms and went back to bed-
As of 2 pm, the school has given 6,680 shots- The previous record was 3,271-

The Department of Homeland Security dedicated a massive biodefense laboratory in Frederick yesterday, moving toward the facility's opening despite questions raised about the risks of deadly pathogens to be studied there

When the National Biodefense Analysis and Countermeasures Center at Fort Detrick is fully operational in March, about 150 scientists in the lab will be tasked with protecting the country from a bioterrorist attack through prevention or containment.Another goal is to allow investigators to fingerprint biological agents such as viruses and bacteria, quickly tracing their source and catching the offender
But critics cite the case of Bruce E. Ivins, a researcher at the U.S. Army Medical Research Institute of Infectious Diseases, also at Fort Detrick, as evidence that such installations might help bioterrorists get access to lethal agents.FBI investigators think Ivins, who committed suicide in July, was responsible for the 2001 anthrax attacks
Construction began in June 2006 on the $143 million, 160,000-square-foot facility inside the fort, the Army's sprawling medical research post in Frederick.The ship-shaped building will be divided between the lab's major divisions: a forensic testing center, which aims to identify the culprits in biological attacks; and the Biothreat Characterization Center, which seeks to predict what such attacks will look like and guide the development of countermeasures
Scientists affiliated with the lab have been working in leased space at Fort Detrick, but officials who spoke at the dedication yesterday said they were anxious to move into the new center
"This is a great day. Many of us have been waiting for this day for a long time," said Jamie Johnson, director of the Office of National Laboratories of the Science and Technology Directorate of the Department of Homeland Security. "I feel very passionately about this facility, and I feel even more passionately about its mission.This is state-of-the-art, cutting-edge bio-forensics"
Barry Kissin, a Frederick lawyer who has strongly opposed the lab's construction, said he fears the facility would be used to create biological weapons even though the government said its mission is defensive
"It's not only a huge threat to local public health and safety, it is in the forefront of the instigation of a brand-new arms race in the realm of bioweapons," he said."Here we are, expanding by about 20 times the size of the program that we're now being told generated the only bioattack in our history"
Rep. Roscoe G. Bartlett (R-Md.), who has a PhD in human physiology, said the closure of the U.S.bioweapons program in 1969 had perhaps placed the country a step behind other nations that continued to operate secret programs
"As a scientist, I knew how important it was to be at the cutting edge," Bartlett said. "I don't have complete confidence that our intelligence community will be able to tell us what's going on at the cutting edge." The scientists at the new Detrick lab, he said, are "going to have to divine what's happening." But he said he has "great confidence that this organization will indeed be able to protect us"
Democrat Jennifer Dougherty, a former Frederick mayor who faces Bartlett in the 6th District race, said relations between the city and Fort Detrick have gradually improved
"I think it's essential that we make sure there's a level of transparency and a level of trust between residents, the city and the post," Dougherty said
The directors of the campus were eager to demonstrate the facility's security, leading guests and reporters through a tour of the lab.Construction required everyone to wear hard hats and protective glasses
The facility was clean and bright, with large windows allowing most scientists in sealed labs a view of the outdoors. About 40,000 square feet will be taken up by Biosafety Level 3 labs, which handle agents such as anthrax.In addition, 10,000 will be dedicated to the Level 4 labs, which handle agents such as the Ebola virus
Next to the windows, digital monitors displayed air pressure, ensuring that air would flow from the outside into the lab. The air is constantly filtered, and three large pressure cookers sterilize contaminated waste.To get into the Level 4 labs, workers must pass through a chemical shower that cleanses their suits
The thick, reinforced concrete walls were painted white. The rooms were empty of the testing equipment, animals and biological supplies that the scientists will use for their work.Exposed wires and pipes were in evidence, and sheeting was taped to parts of the floor

Sure, the economy is causing a crisis, but what about anthrax? How about smallpox?
In a little noticed move, federal officials this month have declared a series of public health emergencies relating to potential weapons of biological terror
On Oct. 1, Health and Human Services Secretary Mike Leavitt declared an anthrax public health emergency. On Oct.10, he declared health emergencies for smallpox, radiation sickness from the detonation of a nuclear device and poisoning from botulinum toxins, the active ingredient of Botox
There’s no clear evidence that terrorists have managed to weaponize anthrax or stolen large caches of Botox from cosmetic surgeons in Beverly Hills
But by declaring these public health emergencies, HHS has granted manufacturers of anti-terrorism drugs and vaccines and others involved with the products protection from lawsuits if the drugs were to cause unfortunate side effects
In the past, drug companies have shied from vaccine development because of low profit margins and legal risks.The actions of HHS are a necessary reassurance to persuade companies to make the drugs, and doctors and other providers to administer them, federal officials and some terrorism experts say
But consumer advocates see it as a giveaway to the drug industry that strips the public of legal protections
“It gives the manufacturers and other people involved a ‘get out of jail free’ card,” said Joan Claybrook, president of Washington-based Public Citizen
“These are potentially dangerous products. There could be a bad vaccine, and suppose people relied on that?” Claybrook asked.“There is no deterrent if there’s no liability”
The emergency declarations cover a host of antibiotics to fight anthrax infection, anthrax and smallpox vaccines, and a drug to stimulate white blood cell production in people harmed by radiation
Concerns about the safety of vaccines against potential bioweapons have been raised repeatedly in recent years. Some soldiers, for example, have balked at anthrax vaccinations.And a federal effort to inoculate 500,000 doctors, nurses and other health care workers against smallpox resulted in only about 40,000 volunteering for the vaccine
Health and Human Services’ authority to grant drugmakers liability protection comes from a controversial measure that Senate Majority Leader Bill Frist and House Speaker Dennis Hastert added to a Defense Department appropriations bill in the waning days of 2005
The Public Readiness and Emergency Preparedness Act targets liability protections for products used during epidemics and pandemics, or as security countermeasures
The HHS secretary can trigger the protections by declaring that a public health emergency exists or that there’s a “credible risk” of one in the future
And legal immunity can apply to anyone involved in the development, testing, manufacture or distribution of the drugs.Also covered is anyone who prescribes, dispenses or administers the drugs, including state and local government officials
Public Citizen and the Consumer Federation of America were among the groups that protested the bill
In a letter to Frist and Hastert, Sen.Ted Kennedy and 20 other members of Congress called the measure “a stealth provision to shield manufacturers from responsibility for making faulty drugs and vaccines”
As the law was written, it could be applied to virtually any drug or vaccine, Kennedy and the others said, and not just to the medications needed to fight pandemic flu or bioterrorism
For example, HHS could declare widespread problems such as diabetes, obesity or methamphetamine addiction to be epidemics and protect a large variety of drugs from lawsuits
The act does allow lawsuits for “willful misconduct.” But that’s hard to prove, said Claybrook of Public Citizen
“That can never be shown unless there’s a whistle-blower or something turns up in discovery,” she said.“You could be knocked out of court before that happens”
The law also calls for a federal fund to pay damages to people harmed by the drugs or vaccines.But so far, Congress hasn’t appropriated any money for it
While terrorists would like to have biological weapons, they don’t have the sophisticated technology yet to make them, said R. Gregory Evans, director of the Institute for Biosecurity at St.Louis University
“I’m not aware of anything that would raise our alert level for biological (weapons),” he said
But someday, terrorists may develop such weapons, Evans said, which makes countermeasures like vaccines and drugs “absolutely necessary”
“It probably does need some liability protection to get companies to develop vaccines that may never be used,” he said.“The profit margins associated with things like this are very little”
Health and Human Services is not invoking the law in response to any immediate threat, said William Raub, science adviser to Leavitt
“We don’t believe there’s anything imminent,” he said.“We’ve tried to be careful to not instill fear in people, (but) if we wait until the day of an event, valuable time is lost … and people could die”
HHS started working on the emergency declarations last spring and would have issued them sooner, Raub said, but didn’t want them to get tangled in the controversy this summer over government bioweapons researcher Bruce Ivins
In August, federal authorities said Ivins, who committed suicide, was solely responsible for the 2001 anthrax attacks that killed five people and frightened the nation
The new public health emergencies remain in effect through 2015.And liability protections will extend for an additional year
“These are not partisan issues,” Raub said.“These are right and need to be done
“The statute would never have occurred if the majority of Congress didn’t think so.We are a litigious society”
But Claybrook of Public Citizen isn’t convinced
“They’re misusing this whole concept of an emergency, and if there were an emergency, you still have to behave,” she said.“I don’t think it’s necessary at all”

General Overview
The Department of Homeland Security’s National Biodefense Analysis and Countermeasures Center (NBACC) will provide the nation with essential biocontainment laboratory space for biological threat characterization and bioforensic research
The NBACC facility, managed by Homeland Security’s Science & Technology directorate in accordance with the Homeland Security Act of 2002 and the Homeland Security Presidential Directive entitled “Biodefense for the 21st Century,” will be located within the National Interagency Biodefense Campus at Fort Detrick, Maryland
The programs conducted at NBACC will provide knowledge of infectious properties of biological agents, effectiveness of countermeasures, decontamination procedures, and forensics analyses to support policy makers and responders’ development of policies, programs, and technologies
NBACC is part of a nationwide group of institutions that collectively are referred to as the Homeland Security Biodefense Complex.The Complex includes the Plum Island Animal Disease Control Center, the Biodefense Knowledge Center, the national laboratories, and the university-based Homeland Security Centers of Excellence

The National Bioforensic Analysis Center (NBFAC), is designated in Presidential Directive “Biodefense for the 21st Century, to be the lead federal facility to conduct and facilitate the technical forensic analysis and interpretation of materials recovered following a biological attack in support of the appropriate lead federal agency.NBFAC conducts bioforensic analysis of evidence from a bio-crime or terrorist attack to attain a “biological fingerprint” to identify perpetrators and determine the origin and method of attack
The Biological Threat Characterization Center (BTCC) will conduct studies and laboratory experiments to fill in information gaps to better understand current and future biological threats, assess vulnerabilities, conduct risk assessments, and determine potential impacts in order to guide the development of countermeasures such as detectors, drugs, vaccines, and decontamination technologies to protect the U.S.against these threats
Facility Status
DHS completed the environmental planning and public review process for the construction of the NBACC facility with a Record of Decision on January 26, 2005.It is anticipated that an architectural and engineering (A&E) contract will be awarded late March 2005 to allow groundbreaking to take place in the summer of 2006 and completion of the project in 2008
A contract is scheduled to be awarded in March to begin design of the NBACC facility
The gross space, or entire footprint, is expected to be about 160,000 square feet.This includes administration areas, BSL- 2, 3 and 4 laboratory space, air handling equipment space, security controls, and other supporting features
The anticipated number of researchers and support staff is approximately 120
An interim capability for the NBFAC has been established in partnership with the FBI and the U.S. Army at the U.S. Army Medical Research Institute of Infectious Diseases (USAMRIID) at Fort Detrick.Also, some threat characterization research and studies are being conducted in other established private and government laboratories, including USAMRIID

The enactment went as follows:Patients with a mysterious illness began appearing at Oklahoma City hospitals in early December of 2002, with fever, weakness, malaise, and an aggressive rash which in two or three days developed pus. Except for the other symptoms they could have been severe cases of acne.Soon the small number of initial patients grew to 20; others sprouted across the state as well as in Georgia and Pennsylvania.Most living practicing physicians have never treated a clinical case of this mysterious disease, which fit no current pattern of development, defying differential diagnosis Days later the Centers for Disease Control and Prevention made the diagnosis: smallpox. It is a disease not seen in the United States since 1949…and not in the world since 1980. It is an extinct malady.Its only vestiges are two small cultures held in labs in the United States and Russia This is certainly an intentional, engineered outbreak of the disease…bioterrorism!
By the end of the month there were projected to be 30,000 cases nationwide. In the weeks before the outbreak, tensions were rising between China and Taiwan. An outbreak of foot and mouth disease on Taiwan was devastating the swine industry; some blamed China.Iraq had begun moving troops toward the Kuwaiti border, claiming its action to be routine exercises

The exercise was sponsored by several think tanks, including the Johns Hopkins Center for Civilian Biodefense Studies. It was designed to simulate what many experts say is highly likely: a biological weapon attack upon the United States.The exercise exposed numerous shortcomings in how government and the nation's health care system are equipped to deal with such a crisis.Hospitals don't have the beds or staff to care for the sick in the event of a "surge" of bio-terrorism victims.There is not enough smallpox vaccine - or any other vaccine - to immunize the nation
Finally, the exercise exposes "fault lines" and "disconnects" among local, state and federal officials, leaving many of them to ask: Who's in charge?
Dark Winter pinpointed the serious lack of smallpox vaccine. There are 12 million doses of smallpox vaccine for 275 million Americans. Sam Nunn told lawmakers afterward that "That's enough for one out of ever 23 Americans…. Who do we decide to vaccinate?"Certain moral issues were raised by it as well. In his role as president, Sam Nunn refused a request from the governor of Oklahoma for enough vaccine to inoculate everyone in the state. His function, he said, was to conserve the supply and lookafter the interests of the entire nation. Of course, as Governor Keating pointed out, "Vaccination cannot stop the spread if you don't have enough of it."Other concerns include police, firefighters and other local emergency personnel who lack the necessary training and equipment to handle a bioterrorist attack. Emergency management personnel don't have the tools to determine that there has actually been such an attack."We have a fragmented and under-funded public health system - at the local, state and federal level - that does not allow us to effectively detect and track disease outbreaks in real time" Keating said
This is not the first such simulation that has been practiced. Last year the Department of Justice and other federal agencies simulated chemical and biological attacks in Washington, DC, Denver and Portsmouth, NH. In Denver, bubonic plague was the chosen biological weapon.The hospitals quickly became overwhelmed and antibiotics and ventilators were soon in short supply
There is increasing likelihood that the catastrophes portrayed in such exercises will become reality. Defense Secretary Donald H. Rumsfeld has said the bioterrorist threat is "quite high," with nations such as Iraq, Iran, China and North Korea building the weapons. The US renounced such weapons in 1969 and started destroying stockpiles.There has been some progress against such possible attacks. The Centers for Disease Control and Prevention (CDCP) has contracted with a Maryland firm to produce 40 million doses of smallpox vaccine. A senior adviser on bioterrorism has been appointed to Tommy Thompson, Secretary of Health and Human Services.But Sam Nunn asserts that more has to be done - and quickly."In the evolution of warfare, arrows were countered by shields; swords with armor; guns with tanks; and now biological weapons must be countered with medicines, vaccines and surveillance systems"

To me the most interesting bit is the Confidence in government part which may indicate how such a Bioterrorism attack may be roled out to the public'Confidence and Trust in GovernmentAmericans trust the CDC to give them accurate and reliable information (84%), and that doesn’t vary much by race, gender, region, or politics (nor has it varied much over the years). In contrast, only 63% of Americans polled trust FEMA to provide reliable and accurate information, less than a mayor (75%) or the sheriff or police commissioner (82%).The least trusted source of information is the president at 49%, with more Americans trusting a TV medical correspondent (71%) to give them reliable information.Confidence in President Bush has declined steadily, from 65% in 2003 to 49% in 2007. LEXINGTON, Va., Oct.23, 2008 – The entire student body of Virginia Military Institute will have the chance to receive a flu vaccination next week as the Institute tests its ability to respond to a flu pandemic
The 1,400 members of the VMI Corps of Cadets will process through the inoculation stations on Oct. 28 and Oct. 29. The exercise is designed to test the VMI Pandemic Flu Plan administrative accountability and control system while working in conjunction with a real world medical process. After processing and signing in, the cadets can opt not to receive a vaccination.The cadets will decide when during the two-day period they check in at the processing station to avoid interfering with their class schedules
Employees of the VMI Physical Plant Department will process through the inoculation stations the morning of Oct. 30 to test the ability of the plan’s administrative system to handle employees being processed for vaccination. The employees also can opt to not have a vaccination.Other Institute employees will be able to receive vaccinations at the conclusion of the exercise if any vaccine remains available
“This is a realistic scenario of how we would administer, control, and provide inoculations to the entire VMI community if a flu pandemic ever materializes,” said Dr. David Copeland, the Institute physician.“The idea of a pandemic is not nearly so prominent in the minds of the public as it was a year or two ago, but the potential is always there”
Historically, about one-quarter of the student body is inoculated for the flu each year at the VMI Infirmary.Copeland said he expects more cadets to be vaccinated this year because of this exercise
“Even without a pandemic, the more cadets we can get vaccinated, the better,” he said.“We should see a suppression of the incidence of flu among cadets in what we expect to be a normal flu season if we can get a higher percentage of cadets vaccinated”
The infirmary staff will establish the inoculation station at Cameron Hall. A significant number of VMI cadets are trained emergency medical technicians. The cadet EMTs will help with the process in accordance with the VMI Pandemic Flu Plan.The VMI Women’s Club, all of whom are local volunteers, will be on hand helping with administrative in-processing while also providing a rest area and snacks for those receiving inoculations
Col. James N. Joyner Jr., director of Auxiliary Services for VMI and the chairman of the Institute’s Emergency Planning Committee, said the exercise will help VMI test and refine a significant portion of its Pandemic Flu response plans
“This will let us see how well we can handle a large number of patients expeditiously,” Joyner said.“We’ll see how well we can account for members of the VMI family during an emergency”

When it comes to observing US and international laws, treaties and norms, the Bush administration is a serial offender Since 2001, it's:
-- spurned efforts for nuclear disarmament to advance its weapons program and retain current stockpiles;
-- renounced the 1970 Nuclear Non-Proliferation Treaty (NPT) and asserted the right to develop and test new weapons;
-- abandoned the 1972 Anti-Ballistic Missile Treaty (ABM) because it expressly forbids the development, testing and deployment of missile defenses like its Terminal High Altitude Area Defense (THAAD) and other programs;
-- refuses to adopt a proposed Fissile Material Cutoff Treaty (FMCT) that would prohibit further weapons-grade uranium and plutonium production and prevent new nuclear weapons to be added to present stockpiles - already dangerously too high;
-- spends more on the military than the rest of the world combined plus multi-billions off-the-books, for secret programs, and for agencies like the CIA;
-- advocates preventive, preemptive and "proactive" wars globally with first-strike nuclear and other weapons under the nihilistic doctrines of "anticipatory self-defense" and remaking the world to be like America;
-- rescinded and subverted the 1972 Biological Weapons Convention (BWC) to illegally develop new biowarfare weapons; in November 1969 and February 1970, Richard Nixon issued National Security Decision Memoranda (NSDM) 35 and 44; they renounced the use of lethal and other types of biological warfare and ordered existing weapons stockpiles destroyed, save for small amounts for research - a huge exploitable loophole; the Reagan and Clinton administrations took advantage; GHW Bush to a lesser degree;

Not a single case of human anthrax has been reported in the United States this year, but the nation is now officially in a state of anthrax emergency
The emergency was declared earlier this month by the Department of Health and Human Services, and will last until 2015.Whether it will protect public health is debatable, but it will certainly protect makers of faulty anthrax vaccines
Emergency exemption from legal liability is granted to vaccine manufacturers by the Public Readiness and Preparedness Act, passed in 2005 to protect against paralyzing lawsuits during outbreaks of anthrax, avian influenza or other potentially pandemic diseases
The act is supposed to be invoked when the Secretary of Homeland Security has determined "that there is a domestic emergency, or a significant potential for a domestic emergency, involving a heightened risk of attack with a specified biological, chemical, radiological, or nuclear agent or agents"
But as Homeland Security chief Michael Chertoff explains in a letter to the DHHS, none of these conditions are met: there's neither emergency nor heightened risk of attack nor "credible information indicating an imminent threat of an attack." But that doesn't matter
"These findings are not necessary to make a determination," Chertoff wrote. It's enough that anthrax was declared a threat four years ago, and that "were the government to determine in the future that there is a heightened risk of an anthrax attack ... that determination would almost certainly result in a domestic emergency"
In other words, there could be an emergency someday — so we might as well declare an emergency now
Beyond the tortured logic, there's something not quite right about this Could it have something to do with the fact that the federal government has spent nearly a billion dollars on anthrax vaccines of questionable efficacy and safety?
The CDC's vaccine committee meets next week to discuss anthrax vaccines.It will be interesting to see what they say

Huge New Biodefense Lab Is Dedicated at Fort Detrick

The Department of Homeland Security dedicated a massive biodefense laboratory in Frederick yesterday, moving toward the facility's opening despite questions raised about the risks of deadly pathogens to be studied there

When the National Biodefense Analysis and Countermeasures Center at Fort Detrick is fully operational in March, about 150 scientists in the lab will be tasked with protecting the country from a bioterrorist attack through prevention or containment.Another goal is to allow investigators to fingerprint biological agents such as viruses and bacteria, quickly tracing their source and catching the offender
But critics cite the case of Bruce E. Ivins, a researcher at the U.S. Army Medical Research Institute of Infectious Diseases, also at Fort Detrick, as evidence that such installations might help bioterrorists get access to lethal agents.FBI investigators think Ivins, who committed suicide in July, was responsible for the 2001 anthrax attacks
Construction began in June 2006 on the $143 million, 160,000-square-foot facility inside the fort, the Army's sprawling medical research post in Frederick.The ship-shaped building will be divided between the lab's major divisions: a forensic testing center, which aims to identify the culprits in biological attacks; and the Biothreat Characterization Center, which seeks to predict what such attacks will look like and guide the development of countermeasures
Scientists affiliated with the lab have been working in leased space at Fort Detrick, but officials who spoke at the dedication yesterday said they were anxious to move into the new center
"This is a great day. Many of us have been waiting for this day for a long time," said Jamie Johnson, director of the Office of National Laboratories of the Science and Technology Directorate of the Department of Homeland Security. "I feel very passionately about this facility, and I feel even more passionately about its mission.This is state-of-the-art, cutting-edge bio-forensics"
Barry Kissin, a Frederick lawyer who has strongly opposed the lab's construction, said he fears the facility would be used to create biological weapons even though the government said its mission is defensive
"It's not only a huge threat to local public health and safety, it is in the forefront of the instigation of a brand-new arms race in the realm of bioweapons," he said."Here we are, expanding by about 20 times the size of the program that we're now being told generated the only bioattack in our history"
Rep. Roscoe G. Bartlett (R-Md.), who has a PhD in human physiology, said the closure of the U.S.bioweapons program in 1969 had perhaps placed the country a step behind other nations that continued to operate secret programs
"As a scientist, I knew how important it was to be at the cutting edge," Bartlett said. "I don't have complete confidence that our intelligence community will be able to tell us what's going on at the cutting edge." The scientists at the new Detrick lab, he said, are "going to have to divine what's happening." But he said he has "great confidence that this organization will indeed be able to protect us"
Democrat Jennifer Dougherty, a former Frederick mayor who faces Bartlett in the 6th District race, said relations between the city and Fort Detrick have gradually improved
"I think it's essential that we make sure there's a level of transparency and a level of trust between residents, the city and the post," Dougherty said
The directors of the campus were eager to demonstrate the facility's security, leading guests and reporters through a tour of the lab.Construction required everyone to wear hard hats and protective glasses
The facility was clean and bright, with large windows allowing most scientists in sealed labs a view of the outdoors. About 40,000 square feet will be taken up by Biosafety Level 3 labs, which handle agents such as anthrax.In addition, 10,000 will be dedicated to the Level 4 labs, which handle agents such as the Ebola virus
Next to the windows, digital monitors displayed air pressure, ensuring that air would flow from the outside into the lab. The air is constantly filtered, and three large pressure cookers sterilize contaminated waste.To get into the Level 4 labs, workers must pass through a chemical shower that cleanses their suits
The thick, reinforced concrete walls were painted white. The rooms were empty of the testing equipment, animals and biological supplies that the scientists will use for their work.Exposed wires and pipes were in evidence, and sheeting was taped to parts of the floor

Sure, the economy is causing a crisis, but what about anthrax? How about smallpox?
In a little noticed move, federal officials this month have declared a series of public health emergencies relating to potential weapons of biological terror
On Oct. 1, Health and Human Services Secretary Mike Leavitt declared an anthrax public health emergency. On Oct.10, he declared health emergencies for smallpox, radiation sickness from the detonation of a nuclear device and poisoning from botulinum toxins, the active ingredient of Botox
There’s no clear evidence that terrorists have managed to weaponize anthrax or stolen large caches of Botox from cosmetic surgeons in Beverly Hills
But by declaring these public health emergencies, HHS has granted manufacturers of anti-terrorism drugs and vaccines and others involved with the products protection from lawsuits if the drugs were to cause unfortunate side effects
In the past, drug companies have shied from vaccine development because of low profit margins and legal risks.The actions of HHS are a necessary reassurance to persuade companies to make the drugs, and doctors and other providers to administer them, federal officials and some terrorism experts say
But consumer advocates see it as a giveaway to the drug industry that strips the public of legal protections
“It gives the manufacturers and other people involved a ‘get out of jail free’ card,” said Joan Claybrook, president of Washington-based Public Citizen
“These are potentially dangerous products. There could be a bad vaccine, and suppose people relied on that?” Claybrook asked.“There is no deterrent if there’s no liability”
The emergency declarations cover a host of antibiotics to fight anthrax infection, anthrax and smallpox vaccines, and a drug to stimulate white blood cell production in people harmed by radiation
Concerns about the safety of vaccines against potential bioweapons have been raised repeatedly in recent years. Some soldiers, for example, have balked at anthrax vaccinations.And a federal effort to inoculate 500,000 doctors, nurses and other health care workers against smallpox resulted in only about 40,000 volunteering for the vaccine
Health and Human Services’ authority to grant drugmakers liability protection comes from a controversial measure that Senate Majority Leader Bill Frist and House Speaker Dennis Hastert added to a Defense Department appropriations bill in the waning days of 2005
The Public Readiness and Emergency Preparedness Act targets liability protections for products used during epidemics and pandemics, or as security countermeasures
The HHS secretary can trigger the protections by declaring that a public health emergency exists or that there’s a “credible risk” of one in the future
And legal immunity can apply to anyone involved in the development, testing, manufacture or distribution of the drugs.Also covered is anyone who prescribes, dispenses or administers the drugs, including state and local government officials
Public Citizen and the Consumer Federation of America were among the groups that protested the bill
In a letter to Frist and Hastert, Sen.Ted Kennedy and 20 other members of Congress called the measure “a stealth provision to shield manufacturers from responsibility for making faulty drugs and vaccines”
As the law was written, it could be applied to virtually any drug or vaccine, Kennedy and the others said, and not just to the medications needed to fight pandemic flu or bioterrorism
For example, HHS could declare widespread problems such as diabetes, obesity or methamphetamine addiction to be epidemics and protect a large variety of drugs from lawsuits
The act does allow lawsuits for “willful misconduct.” But that’s hard to prove, said Claybrook of Public Citizen
“That can never be shown unless there’s a whistle-blower or something turns up in discovery,” she said.“You could be knocked out of court before that happens”
The law also calls for a federal fund to pay damages to people harmed by the drugs or vaccines.But so far, Congress hasn’t appropriated any money for it
While terrorists would like to have biological weapons, they don’t have the sophisticated technology yet to make them, said R. Gregory Evans, director of the Institute for Biosecurity at St.Louis University
“I’m not aware of anything that would raise our alert level for biological (weapons),” he said
But someday, terrorists may develop such weapons, Evans said, which makes countermeasures like vaccines and drugs “absolutely necessary”
“It probably does need some liability protection to get companies to develop vaccines that may never be used,” he said.“The profit margins associated with things like this are very little”
Health and Human Services is not invoking the law in response to any immediate threat, said William Raub, science adviser to Leavitt
“We don’t believe there’s anything imminent,” he said.“We’ve tried to be careful to not instill fear in people, (but) if we wait until the day of an event, valuable time is lost … and people could die”
HHS started working on the emergency declarations last spring and would have issued them sooner, Raub said, but didn’t want them to get tangled in the controversy this summer over government bioweapons researcher Bruce Ivins
In August, federal authorities said Ivins, who committed suicide, was solely responsible for the 2001 anthrax attacks that killed five people and frightened the nation
The new public health emergencies remain in effect through 2015.And liability protections will extend for an additional year
“These are not partisan issues,” Raub said.“These are right and need to be done
“The statute would never have occurred if the majority of Congress didn’t think so.We are a litigious society”
But Claybrook of Public Citizen isn’t convinced
“They’re misusing this whole concept of an emergency, and if there were an emergency, you still have to behave,” she said.“I don’t think it’s necessary at all”

General Overview
The Department of Homeland Security’s National Biodefense Analysis and Countermeasures Center (NBACC) will provide the nation with essential biocontainment laboratory space for biological threat characterization and bioforensic research
The NBACC facility, managed by Homeland Security’s Science & Technology directorate in accordance with the Homeland Security Act of 2002 and the Homeland Security Presidential Directive entitled “Biodefense for the 21st Century,” will be located within the National Interagency Biodefense Campus at Fort Detrick, Maryland
The programs conducted at NBACC will provide knowledge of infectious properties of biological agents, effectiveness of countermeasures, decontamination procedures, and forensics analyses to support policy makers and responders’ development of policies, programs, and technologies
NBACC is part of a nationwide group of institutions that collectively are referred to as the Homeland Security Biodefense Complex.The Complex includes the Plum Island Animal Disease Control Center, the Biodefense Knowledge Center, the national laboratories, and the university-based Homeland Security Centers of Excellence

The National Bioforensic Analysis Center (NBFAC), is designated in Presidential Directive “Biodefense for the 21st Century, to be the lead federal facility to conduct and facilitate the technical forensic analysis and interpretation of materials recovered following a biological attack in support of the appropriate lead federal agency.NBFAC conducts bioforensic analysis of evidence from a bio-crime or terrorist attack to attain a “biological fingerprint” to identify perpetrators and determine the origin and method of attack
The Biological Threat Characterization Center (BTCC) will conduct studies and laboratory experiments to fill in information gaps to better understand current and future biological threats, assess vulnerabilities, conduct risk assessments, and determine potential impacts in order to guide the development of countermeasures such as detectors, drugs, vaccines, and decontamination technologies to protect the U.S.against these threats
Facility Status
DHS completed the environmental planning and public review process for the construction of the NBACC facility with a Record of Decision on January 26, 2005.It is anticipated that an architectural and engineering (A&E) contract will be awarded late March 2005 to allow groundbreaking to take place in the summer of 2006 and completion of the project in 2008
A contract is scheduled to be awarded in March to begin design of the NBACC facility
The gross space, or entire footprint, is expected to be about 160,000 square feet.This includes administration areas, BSL- 2, 3 and 4 laboratory space, air handling equipment space, security controls, and other supporting features

Finally, the exercise exposes "fault lines" and "disconnects" among local, state and federal officials, leaving many of them to ask: Who's in charge?
Dark Winter pinpointed the serious lack of smallpox vaccine. There are 12 million doses of smallpox vaccine for 275 million Americans. Sam Nunn told lawmakers afterward that "That's enough for one out of ever 23 Americans…. Who do we decide to vaccinate?"Certain moral issues were raised by it as well. In his role as president, Sam Nunn refused a request from the governor of Oklahoma for enough vaccine to inoculate everyone in the state. His function, he said, was to conserve the supply and lookafter the interests of the entire nation. Of course, as Governor Keating pointed out, "Vaccination cannot stop the spread if you don't have enough of it."Other concerns include police, firefighters and other local emergency personnel who lack the necessary training and equipment to handle a bioterrorist attack. Emergency management personnel don't have the tools to determine that there has actually been such an attack."We have a fragmented and under-funded public health system - at the local, state and federal level - that does not allow us to effectively detect and track disease outbreaks in real time" Keating said
This is not the first such simulation that has been practiced. Last year the Department of Justice and other federal agencies simulated chemical and biological attacks in Washington, DC, Denver and Portsmouth, NH. There is increasing likelihood that the catastrophes portrayed in such exercises will become reality. Defense Secretary Donald H. LEXINGTON, Va., Oct.23, 2008 – The entire student body of Virginia Military Institute will have the chance to receive a flu vaccination next week as the Institute tests its ability to respond to a flu pandemic
The 1,400 members of the VMI Corps of Cadets will process through the inoculation stations on Oct. 28 and Oct. 29. The exercise is designed to test the VMI Pandemic Flu Plan administrative accountability and control system while working in conjunction with a real world medical process. After processing and signing in, the cadets can opt not to receive a vaccination.The cadets will decide when during the two-day period they check in at the processing station to avoid interfering with their class schedules
Employees of the VMI Physical Plant Department will process through the inoculation stations the morning of Oct. 30 to test the ability of the plan’s administrative system to handle employees being processed for vaccination. The employees also can opt to not have a vaccination.Other Institute employees will be able to receive vaccinations at the conclusion of the exercise if any vaccine remains available
“This is a realistic scenario of how we would administer, control, and provide inoculations to the entire VMI community if a flu pandemic ever materializes,” said Dr. David Copeland, the Institute physician.“The idea of a pandemic is not nearly so prominent in the minds of the public as it was a year or two ago, but the potential is always there”
Historically, about one-quarter of the student body is inoculated for the flu each year at the VMI Infirmary.Copeland said he expects more cadets to be vaccinated this year because of this exercise
“Even without a pandemic, the more cadets we can get vaccinated, the better,” he said.“We should see a suppression of the incidence of flu among cadets in what we expect to be a normal flu season if we can get a higher percentage of cadets vaccinated”
The infirmary staff will establish the inoculation station at Cameron Hall. A significant number of VMI cadets are trained emergency medical technicians. The cadet EMTs will help with the process in accordance with the VMI Pandemic Flu Plan.The VMI Women’s Club, all of whom are local volunteers, will be on hand helping with administrative in-processing while also providing a rest area and snacks for those receiving inoculations
Col. James N. Joyner Jr., director of Auxiliary Services for VMI and the chairman of the Institute’s Emergency Planning Committee, said the exercise will help VMI test and refine a significant portion of its Pandemic Flu response plans

-- renounced the 1970 Nuclear Non-Proliferation Treaty (NPT) and asserted the right to develop and test new weapons;
-- abandoned the 1972 Anti-Ballistic Missile Treaty (ABM) because it expressly forbids the development, testing and deployment of missile defenses like its Terminal High Altitude Area Defense (THAAD) and other programs;
-- refuses to adopt a proposed Fissile Material Cutoff Treaty (FMCT) that would prohibit further weapons-grade uranium and plutonium production and prevent new nuclear weapons to be added to present stockpiles - already dangerously too high;
-- spends more on the military than the rest of the world combined plus multi-billions off-the-books, for secret programs, and for agencies like the CIA;
-- advocates preventive, preemptive and "proactive" wars globally with first-strike nuclear and other weapons under the nihilistic doctrines of "anticipatory self-defense" and remaking the world to be like America;
-- rescinded and subverted the 1972 Biological Weapons Convention (BWC) to illegally develop new biowarfare weapons; in November 1969 and February 1970, Richard Nixon issued National Security Decision Memoranda (NSDM) 35 and 44; they renounced the use of lethal and other types of biological warfare and ordered existing weapons stockpiles destroyed, save for small amounts for research - a huge exploitable loophole; the Reagan and Clinton administrations took advantage; GHW Bush to a lesser degree;
-- GW Bush went further by renouncing the US Biological Weapons Anti-Terrorism Act of 1989 that prohibits "the Development, Production, and Stockpiling of Bacteriological (Biological) and Toxin Weapons....;" on May 22, 1990, GHW Bush signed it into law to complete the 1972 Convention's implementation; what the father and Nixon established, GW Bush rendered null and void; "Rebuilding America's Defenses" is his central policy document for unchallengeable US hegemony; among other provisions, it illegally advocates advanced forms of biowarfare that can target specific genotypes - the genetic constitution of individual organisms

Not a single case of human anthrax has been reported in the United States this year, but the nation is now officially in a state of anthrax emergency
The emergency was declared earlier this month by the Department of Health and Human Services, and will last until 2015.Whether it will protect public health is debatable, but it will certainly protect makers of faulty anthrax vaccines
Emergency exemption from legal liability is granted to vaccine manufacturers by the Public Readiness and Preparedness Act, passed in 2005 to protect against paralyzing lawsuits during outbreaks of anthrax, avian influenza or other potentially pandemic diseases
The act is supposed to be invoked when the Secretary of Homeland Security has determined "that there is a domestic emergency, or a significant potential for a domestic emergency, involving a heightened risk of attack with a specified biological, chemical, radiological, or nuclear agent or agents"
But as Homeland Security chief Michael Chertoff explains in a letter to the DHHS, none of these conditions are met: there's neither emergency nor heightened risk of attack nor "credible information indicating an imminent threat of an attack." But that doesn't matter
"These findings are not necessary to make a determination," Chertoff wrote. It's enough that anthrax was declared a threat four years ago, and that "were the government to determine in the future that there is a heightened risk of an anthrax attack ... that determination would almost certainly result in a domestic emergency"
In other words, there could be an emergency someday — so we might as well declare an emergency now
Beyond the tortured logic, there's something not quite right about this Could it have something to do with the fact that the federal government has spent nearly a billion dollars on anthrax vaccines of questionable efficacy and safety?
The CDC's vaccine committee meets next week to discuss anthrax vaccines.It will be interesting to see what they say
